Terms of Service

These Terms of Service ("Terms") are an agreement between you and Baldwin Consultations LLC, a New Mexico limited liability company doing business as GigDash ("GigDash," "we," "us," or "our"). They govern your use of the GigDash website, apps, and services (together, the "Service"). Please read them carefully. If you do not agree, do not use the Service.

1. Accepting these Terms

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. You confirm that you are a parent or guardian setting up the Service for your household.

2. What GigDash does

GigDash helps families organize chores and tasks. A parent creates an account, sets up children and their tasks, and manages the household from the web or mobile app. If enabled, a kids panel lets a child view and check off the tasks assigned to them on a shared household screen. Some features require a paid subscription (see below).

3. Your account

• Provide accurate information and keep it up to date.
• Keep your sign-in credentials secure; you are responsible for activity under your account.
• You may invite additional parents/guardians ("co-parents") to your household. You are responsible for who you invite and for their use of the Service within your household. Only the account owner can manage billing and close the account.
• You are responsible for the children in your household who use the kids panel, for what you set up for them, and for supervising their use as appropriate for their age.
• Tell us promptly at [email protected] if you suspect unauthorized use of your account.

4. Subscriptions, billing, and cancellation

• GigDash offers a free tier and a paid Family plan billed on a recurring monthly basis. Current pricing is shown at checkout.
• Payments are processed by Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method for the plan you select.
• Your subscription renews automatically each billing period until you cancel. You can cancel anytime from your account's billing management; cancellation takes effect at the end of the current paid period, and you keep paid access until then.
• Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.
• We may change plan features or pricing. If we change the price of your plan, we will give you advance notice, and the change will apply to your next billing period; continuing to use the paid plan after the change means you accept the new price.
• If a payment fails, we may retry it and may suspend or downgrade paid features until payment is resolved.

5. GigDash Board (hardware)

The GigDash Board is an optional physical device that displays your family's dashboard on a screen (for example, a TV over HDMI). The Board is coming soon and not yet available for purchase; when it is offered for sale, the following terms govern its purchase and use, together with the price, taxes, shipping, and any promotion shown to you at checkout.

• Purchase. The Board is a one-time hardware purchase, separate from any subscription, processed by Stripe. The Board's software features require an active GigDash account, and some features require a paid Family plan.
• Shipping and risk of loss. We ship only to the regions offered at checkout. Delivery dates are estimates, not guarantees. You are responsible for providing a correct shipping address; risk of loss passes to you when the Board is delivered to you.
• Returns. You may return an undamaged Board in its original condition within 30 days of delivery for a refund of the purchase price (original shipping charges may be non-refundable). Contact [email protected] to start a return, and please factory-reset the Board before sending it back. Boards that are damaged, modified, or missing parts may not qualify.
• Limited hardware warranty. We warrant the Board against defects in materials and workmanship, under normal use, for one (1) year from delivery. To make a claim, contact [email protected]. We may require you to return the Board, or provide reasonable proof of the defect, so we can verify it; we will provide return instructions and, for a confirmed warranty claim, a prepaid shipping label. If the Board is defective within the period, we will, at our option, repair it, replace it, or refund the purchase price. This is your exclusive remedy. Please factory-reset the Board before returning it; returned Boards are wiped. The warranty does not cover damage from misuse, accident, liquids, unauthorized modification or repair, or normal wear. To the extent permitted by law, any implied warranties are limited to this one-year period; some jurisdictions do not allow such limits, so this may not apply to you.
• Software and updates. The software on the Board is licensed, not sold, and remains our property. The Board automatically downloads and installs updates so it stays current and secure; by using it you consent to those updates. The Board is designed to work with the GigDash service. If your account or subscription lapses, or the service is unavailable, some or all of the Board's features may stop working.
• Care and safe use. The Board is for indoor household use. Use only the supplied or a compatible power source, keep it ventilated, and follow the setup instructions. Do not open, modify, or repurpose the hardware; doing so is at your own risk and may void the warranty.

6. Acceptable use

You agree not to: use the Service for any unlawful purpose; attempt to access accounts or data that are not yours; interfere with or disrupt the Service; probe, scan, or breach security or authentication; reverse engineer or copy the Service except as permitted by law; or use the Service to harass, harm, or exploit anyone, including children. We may suspend or terminate accounts that violate these Terms.

7. Your content

You keep ownership of the household information you enter (such as children's nicknames, tasks, and completions). You grant us a limited license to store, process, and display that information solely to operate and provide the Service to you. You are responsible for the information you enter and confirm you have the right to provide it, including information about the children in your household.

8. Intellectual property

The Service, including its software, design, logos, and the "GigDash" name, is owned by us and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your household in accordance with these Terms. You may not use our branding without our permission.

9. Third-party services and app stores

The Service relies on third parties (for example, Stripe for payments, email and push-notification providers, and hosting and network providers). Their services are governed by their own terms. If you download our app from the Apple App Store or Google Play, your use is also subject to that store's terms.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, GigDash and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless GigDash and its operator from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of another.

13. Termination

You may stop using the Service and close your account at any time from your settings. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, limitation of liability, and indemnification) will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app or by email. Your continued use of the Service after an update means you accept the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Before filing any formal dispute, you agree to first contact us at [email protected] so we can try to resolve it informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New Mexico, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.
